Who Can File a Wrongful Death Claim in Arizona?
Arizona law limits who is eligible to bring a wrongful death lawsuit. Per A.R.S. § 12-612, the following individuals have standing to file:
- The surviving spouse of the deceased
- A surviving child of the deceased
- A surviving parent or guardian of the deceased
- The personal representative of the deceased’s estate, if no qualifying family members survive
Only one wrongful death lawsuit may be filed per death under Arizona law. The person who brings the claim does so on behalf of all eligible beneficiaries, and any compensation recovered is distributed in proportion to each person’s individual losses.
Note further that wrongful death claims are separate from survival actions. A survival action allows the estate to seek compensation for losses the deceased person suffered between the time of the injury and the time of death. Our experienced wrongful death attorneys can help determine whether one or both types of claims may apply to your family’s situation.
